Trump’s $1.77 Billion “Anti-Weaponization” Fund is Uniquely Bad

Unpacking the federal laws this proposed "Anti-Weaponization" fund violates and why the controversy isn't going away

Let’s talk about President Trump’s proposed $1.776 billion “Anti-Weaponization Fund.” While the Department of Justice has traditional authority to settle cases, this particular fund is uniquely bad and riddled with profound legal flaws.

As I discuss in my latest video, this isn’t an ordinary compromise settlement. A true legal settlement requires an adversarial relationship between two opposing parties. Here, Trump’s DOJ wouldn’t be fighting lawsuits filed by Trump himself, meaning no actual dispute exists to settle.

According to an excellent piece by Lawfare, these payouts would likely violate the Anti-Deficiency Act, making it a criminal offense to spend government money without a congressional appropriation. Furthermore, using a settlement to halt IRS audits would run afoul of federal laws protecting tax investigations. And then there’s the U.S. Constitution, which gives Congress the power of the purse.
