Remember Jeffrey Clark? The Trump Justice Department lawyer who tried to weaponize the federal government to subvert the 2020 election is back in the news. An ethics panel already found that Clark violated his oath, but the current DOJ has stepped in with a lawsuit against the D.C. Bar Association to halt disciplinary proceedings.
They are asserting a new theory of federal immunity, arguing that local bar associations cannot discipline government lawyers acting under a presidential directive. This creates a separate class of untouchable attorneys, shielded from accountability.
We see a similar lack of transparency in the case of John Sarcone, the former interim U.S. Attorney for Northern District of New York. Despite a formal finding of professional misconduct, state privacy rules keep his discipline hidden from the public.
