Federal prosecutors had a double whammy of legal defeats yesterday in the attempted political prosecutions of New York Attorney General Letitia James.
The first major victory for James’ defense occurred in Virginia, where a grand jury took the highly unusual step of refusing to indict James on a mortgage fraud case. The rejection, even after the DOJ brought in a prosecutor from Missouri to present a new version of the indictment, demonstrates the extreme weakness of the case.
On the same day in New York, another Trump-appointed acting U.S. Attorney who is targeting James faced legal challenges over his “unusual appointment.” As I explain, these attempts at vindictive prosecution are collapsing before our eyes.
